and after my return from Albany I was engaged in taking depositions in Chancery as an examiner -- which is business I can do with as much facility as any one I ever knew -- the cause was a very important one and the depositions have already amounted to four hundred and eleven folio - of which I make one copy. & it is expected there will be twenty or thirty witnesses more examined - The only cause which I had decided in the Supreme Court was the one I wrote to you about when I was at Albany. I was allowed double costs which amounted to $109-- I have commenced an action of objection in favor of James Hermann who is a relative of Wm Stewart against Joshua Paine & Marlbro Paine to recover of them a lot of land of about fifty acres -- the circumstances are that Hermann received a Judgement against Joshua (who is the father of Marlbro) before a justice for something over $25 and had a transcript filed in the clerks office. Previous to obtaining the judgement Joshua had given a deed to Marlbro but it was not put on the record until sometime after the transcript was filed, and was not in fact put on the record until after the land was sold in the execution which was (illegible) in Hermann's judgement -- but it was put on record before the time expired for the Sheriff to give Hermann a deed. Hermann has now got a deed & I have commenced an action against them both for this reason - Joshua lives with Marlbro & has a life lease of a log house & one acre of land part of the fifty acres & I put in a [illeg] in the declaration for that so that if I fail on the one I may perhaps recover for the other but cannot I receive the fifty acres? I was very much gratified by my visit at Albany. I suceeded in my business which brought me there became acquainted with the Chief Justice and had a long conversation with him at his house - I staid in Albany a week & set out on Saturday morning at eleven o'clock in the forenoon & was in Geneva at nine o'clock in the evening on Sunday. I have never enjoyed better health than [illeg] my return. If I can I shall come home the last week in April or the first week in May and stay a week or so, I do not in fact lose any thing by it for I can attend to business with a better relish when I come back. I have had an offer of $100 to go to Halifax in the spring, but it will not [illeg] them bear my expenses if it will that I [illeg]
